RE: DECLARATION OF NON-CONFIDENCE AGAINST UN SRSG AMB. MAHIGA

We, the undersigned Members of Parliament (MPs) of the Somali Transitional Federal Parliament, representingthe people ofSomalia inside andoutside (Diaspora) the country, aredeeply concerned andtroubled by theendless transitional periodand prolonged political stalemate exacerbated by the (UNPOS) United Nations Political Office forSomalia’s failure toconsider the Somalitraditional politics, itslack of capacity,incompetence, corruption and lack of political vision beyond the end of the transitional period of August 2012.

The people of Somalia have been forcefully placed in a straight jacket and have been saddled with a cumbersome Road Map without any clear commitment to fund it in atimely manner. Thisroad map hasfour pillars being:Reach-out and reconciliation, security,constitution process andgood governance which haveto be addressedeffectively while buildingconsensus among thecitizens of Somaliaas the legitimateowners of the tasks ahead of the process.

Excellency,

The TransitionalFederal Government (TFG)of Somalia wasformed in 2004and supposed to have transitioned by August 2011; the transition period has been extended one year by Kampala Accord. Provided the roadmap tasks are completed, the currenttransitional period isscheduled to endon August 2012.Anyway UNPOS as an organization has failedbecause of corruptionand the SRSG’sleadership cripples startingfrom Ambassador FrancoisFall followed by AmbassadorAhmedou Ould Abadalla (misled and derailed the Djibouti Peace Process by doubling the number of theMembers of Parliamentto 550, asize incompatible tothe Somali populationand resources andalso unacceptable to a war-torncountry) and thecurrent SRSG Ambassador Augustine Mahiga.

All those leaders demonstrated lack of capacity to handle the Somali matters in their hands and therefore resulted in the persistent communal conflict.

It is now clear that the TFG itself has lost confidence with UNPOS as more that 200 members of the Transitional Federal Parliament issued press statement denouncing the leadershipof the SRSGDr. Mahiga forbeing negligent onthe current direpolitical situation in Somalia and lack of capacity and vision beyond the transitional period.

About the Stakeholders Consultative Meetings:

NPOS initiated and sponsored the above meetings bearing lot of concerns to start with theparticipants. The TransitionalFederal Institutions (TFIs)of Somalia equitablyrepresent the people of Somalia according to the Transitional Federal Charter.

But UNPOS has jumpedover its facilitationrole by ignoring the ownership, authorityand the legitimacy of the Somali TFIs while violating the Transitional Federal charter by engaging fewunlawfully selected participants(who are already representedin the TFIs).

In themeantime it hasabused the rightsof the absolutemajority of theSomali communities. In other words, UNPOS, out of its mandate, for the consultative meetings deliberately invited participants from Puntland, Galmudug and AHLU Sunna Wal Jamaa(the latter has reconciled with the TFG and therefore has ministerial portfolios in the cabinet, inthe security forces,diplomatic missions andcivil servants) whoare a minority of the Somali population by duplicating their representation at the expenses of the agreed power sharing and the rights of the remaining majority Somali communitiesand thus perpetuating the continuation of the political crisis.

About the Regional Governments:

The Transitional Federal Charter (Article 11, paragraph 2, b) clearly spells out that two or more regions can form a federal state. Contrary UNPOS recognized, encouraged and cooperatedwith small entitiesnumbering over 20and claiming tobe regional governments against the articles of the charter.

About the Road Map and Parliamentary Reforms:

The rumors spread out that the parliament is against the roadmap and reforms are null andvoid. The Membersof the Parliamentpersistently requested theroadmap to be presented tothe parliament fordebates, adding or removing,if any contraryto the Transitional Federal Charter and the laws of the country, and finally to be approved.

This is a normal parliamentary procedure and nothing else.

Those claiming the possible rejection of the roadmap and therefore the parliamentary reforms arevery few opportunistsaiming at jeopardizingthe process toend the transition.

Conclusion:

In conclusion, the undersigned Members of Parliament (MPs) kindly request your good office to immediately replace your current SRSG Ambassador Augustine Mahiga due tothe miserable failure and incompetence in his mission and that we find it very difficult to work with him. We also strongly believe that both the interest of Somalia and the N’s noble mission to Somalia are best served in the discontinuation of the service ofAmbassador Augustine Mahiga.
