UNDERTAKINGS

In this undertaking:

 

“Websites”      mean the websites at www.waagacusub.com and www.waagacusub.net.

 

“Dahabshiil”    means Dahabshiil Transfer Services Limited and any parent, subsidiary or other connected company.

 

IN CONSIDERATION of your agreeing not to commence High Court proceedings against me for defamation in relation the Articles (as defined below), to date, I HEREBY UNDERTAKE that I will:

 

1.                 Immediately remove all articles defamatory of Dahabshiil (or otherwise misleading or inaccurate) from the Website. The list of the articles as received from the Witnesses is as follows:

 

1.1               “Al-Shabaab to bomb money transfer company that processes payments for parliament” dated 17 November 2008;

 

1.2               “Somaliland opposition leader in quest for premiership” dated 20 January 2009;

 

1.3               “Dahabshiil joins Al-Shabaab funding companies Muqdisho” dated 28 January 2009;

 

1.4               “Al Shebab Buisness Tycoons hard at work to close down Waagacusub.com” dated 16 March 2009;

 

1.5               “Abdullahi Nuurre Aw Diini Unable to Conceal his Support for Al Shebab Khawaarij” dated 17 March 2009; and

 

1.6               “Khawaarijs fail to close down Waagacusub” dated 18 March 2009.

 

1.7               “Assassination of Veteran Journalist Saeed Tahlil Linked to Ahmed Nuurre Aw Diini” dated 21 February 2009.

 

(the above are referred to above and below as the “Articles”)

 

2.                 not now or at any time hereafter whether acting by myself, my partners,  servants, agents or any of them arrange for the Articles to be placed on the Website or republished in any form in any media anywhere in the world.

 

3.                 not now or at any time hereafter whether acting by himself, his partners,  servants, agents or any of them make or publish any defamatory, derogatory, disparaging or inaccurate statements, comments, remarks, information or communication of any kind whatsoever anywhere in the world, in relation to Dahabshiil whether expressly or by reference to any other name by which Dahabshiil may be known or referred to, including without limitation Dhiigshiil, OR ASSOCIATED NAMES or any of Dahabshiil’s owners, employees, servants or agents including Aw Diini.

 

4.                 not cause, enable, permit, suffer or assist any other person to do any of the acts described in paragraphs 2 and 3 above which I have agreed not to do.

 

I acknowledge that this undertaking does not affect your right to take other proceedings.
